ميثاق روما للمحكمة الجنائية الدولية
ميثاق روما للمحكمة الجنائية الدولية 0عادة ما يشار إليها بميثاق المحكمة الجنائية الدولية أو ميثاق روما)، هي معاهدة تأسس بموبها المحكمة الجنائية الدولية.[5] اعتمدت في مؤتمراً دبلوماسياً عُقد في روما في 17 يوليو 1998[6][7] ودخلت حيز التنفيذ في 1 يوليو 2002.[2] اعتباراً من مارس 2019، كان هناك 124 دولة عضو في الميثاق.[2] من بين أمور أخرى، يحدد الميثاق مهام المحكمة، الاختصاص والتنظيم.

تأسس بموجب ميثاق روما أربع جرائم دولية أساسية: الإبادة الجماعية، الجرائم ضد الإنسانية، جرائم الحرب وجرائم العدوان. "لا تخضع هذه الجرائم لأي قانون تقادم".[8] بموجب ميثاق روما، فغن المحكمة الجنائية الدولية هي المحكمة الوحيدة المنوطة بالتحقيق في الجرائم الدولية الأساسية الأربعة ومقاضاة مرتكبيها في الحالات التي تكون فيها الدول "غير قادرة" أو "غير راغبة" في القيام بذلك بنفسها؛ الاختصاص القضائي للمحكمة مكمل لاختصاص المحاكم المحلية. يكون للمحكمة اختصاص على الجرائم فقط إذا ارتكبت في دولة عضو في الميثاق أو إذا ارتكبها مواطن من دولة عضو؛ استثناء هذه القاعدة هو أن المحكمة الجنائية الدولية قد يكون لها أيضًا اختصاص على الجرائم إذا كان اختصاصها مخول به من قبل مجلس الأمن الدولي.
